Terms of Service

These Terms of Service ("Terms") govern your use of the MOTRaxis and MOTRaxis Workshop mobile applications and platform ("Service") operated by Softwairz ("we", "us", "our"). By downloading, installing, or using MOTRaxis, you agree to be bound by these Terms.
1. Definitions
- "Workshop" — A registered automotive repair business using MOTRaxis Workshop to manage operations.
- "Vehicle Owner" — An individual using the MOTRaxis app to access their vehicle's service history and book appointments.
- "MOTRaxis Pro" — The optional paid subscription tier for vehicle owners that provides advanced analytics, predictive alerts, vehicle valuation insights, and other premium features.
- "Platform Partner" — An authorized representative who refers workshops to MOTRaxis and earns commissions.
- "Digital Vehicle Passport" — The lifetime service history record maintained for each vehicle on the platform.
- "Health Score" — A proprietary estimated score reflecting a vehicle's maintenance standing, calculated by the MOTRaxis algorithm based on service history, mileage patterns, and reminder adherence.
- "Verified Badge" — An indicator applied to service records that have been confirmed by both the workshop that performed the work and the vehicle owner.
2. Eligibility
You must be at least 18 years old to create an account or use the Service. By using MOTRaxis, you represent and warrant that you meet this age requirement. If we learn that a user is under 18, we will promptly terminate their account.
3. Account Registration & Responsibilities
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
- One workshop account corresponds to one physical workshop location.
- You must promptly update your account information if it changes.
- You may not share, transfer, or sell your account to another person or entity without our prior written consent.
- We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to use the Service to:
- Submit false, misleading, or fabricated service records, vehicle information, or reviews.
- Create fake workshop profiles or vehicle owner accounts.
- Scrape, harvest, or programmatically extract data from the platform without our express written permission.
- Send unsolicited messages, spam, or promotional content to other users through the platform.
- Manipulate the Health Score, review ratings, or any other platform metric through fraudulent activity.
- Interfere with or disrupt the Service, servers, or networks connected to the Service.
- Attempt to gain unauthorized access to other users' accounts or data.
- Use the platform for any purpose that violates applicable local, national, or international laws.
5. Free Trial
- New workshop accounts receive a 30-day free trial with all platform fees waived.
- During the trial, all features are fully accessible.
- After the trial period, platform fees apply to completed repair jobs as described in Section 6.
- Trial extensions may be granted at our discretion.
- Tampering with the trial mechanism (e.g., manipulating device time) is a violation of these Terms and may result in immediate account termination.
6. Platform Fees & Subscriptions
- MOTRaxis charges a flat per-job fee on completed repair jobs, deducted from the workshop's wallet balance.
- Fees are tiered based on the job bill amount and the workshop's local currency. Current fee tiers are displayed in the app and on our pricing page.
- Small jobs below the minimum threshold are free (no platform fee).
- Workshops must maintain a positive wallet balance to sync completed jobs. Jobs completed with insufficient balance will be queued until the balance is topped up.
- Fee tiers may be updated with 30 days' advance notice via the app.
6.1 MOTRaxis Pro Subscription (Vehicle Owners)
- MOTRaxis Pro is an optional paid subscription available to vehicle owners. Pricing varies by region (e.g., $3.99/month or $29.99/year in the US). See our pricing page for current rates.
- Pro subscribers receive access to advanced features including smart mileage analytics, predictive service alerts (advanced), vehicle valuation insights, detailed health breakdown, PDF vehicle reports, and priority workshop queue.
- New Pro subscribers receive a 14-day free trial. You may cancel at any time during the trial without being charged.
- Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.
- Cancellation takes effect at the end of the current billing period. No partial refunds are provided for unused time.
- We reserve the right to modify Pro pricing with 30 days' advance notice. Existing subscribers will be grandfathered at their current rate until the end of their billing period.
- The free tier of the MOTRaxis app remains available at no cost and is not affected by Pro subscription status.
7. Wallet & Payments
- Each workshop has a digital wallet within the platform.
- Wallet top-ups are processed via the supported payment methods in your region (JazzCash, EasyPaisa, bank transfer, Stripe, Apple Pay).
- Wallet balances are non-refundable except in cases of account termination initiated by us without cause.
- All transactions are recorded and visible in the wallet history.
8. Workshop Obligations
- Maintain accurate and truthful records of repair jobs, parts used, and services performed. Deliberately entering false service records is grounds for immediate account termination.
- Provide honest and transparent pricing to customers.
- Ensure customer and vehicle data entered into the system is accurate and up to date.
- Respond to platform booking requests and customer inquiries in a timely manner.
- Respond to service record disputes raised by vehicle owners within 14 days of notification.
- Comply with all applicable local laws and regulations governing automotive repair businesses.
- Not use the platform to engage in fraudulent, deceptive, or illegal activities.
- Maintain the confidentiality of customer information accessed through the platform.
9. Vehicle Owner Obligations
- Provide accurate vehicle information (registration number, make, model, year, mileage) when registering vehicles on the platform.
- Use the booking system in good faith — do not make appointments you do not intend to keep.
- Submit reviews that are honest, fair, and based on genuine service experiences.
- Do not register vehicles you do not own or have authorization to manage.
- Vehicle history records are based on data entered by workshops and may not represent a complete service history. You are responsible for verifying vehicle condition through independent inspection when making purchase decisions.
10. Vehicle History & Data Ownership
- Service records entered by workshops become part of the vehicle's Digital Vehicle Passport.
- Vehicle owners can view the complete service history of their registered vehicles.
- Workshops retain ownership of their business data (customer lists, inventory, financial records).
- Vehicle service history data is co-owned: workshops own the record they created, and vehicle owners have the right to access and share their vehicle's complete history.
- When a vehicle is looked up across multiple workshops, the combined service history is presented to the registered owner. This cross-workshop lookup is a core feature of the Digital Vehicle Passport.
- MOTRaxis has a license to use anonymized, aggregated data for platform improvement and analytics.
11. Platform Partner Terms
- Platform partners are independent contractors, not employees of Softwairz.
- Commission rates and structures are defined in individual partner agreements.
- Commissions are calculated monthly based on fees generated by referred workshops.
- Partner status may be suspended or terminated for violation of platform policies or failure to meet performance requirements.
12. Account Suspension & Termination
We may warn, suspend, or terminate any account (workshop, vehicle owner, or partner) for:
- Violation of these Terms of Service
- Submitting false or fabricated service records
- Fraudulent activity or misuse of the platform
- Repeated customer complaints or consistently low review ratings
- Abusive behavior toward other users
- Prolonged inactivity (12+ months)
- Non-payment of platform fees beyond the grace period
Suspended accounts receive a grace period notice and an opportunity to appeal. During suspension, the user can view existing data but not create new records. Terminated accounts may request data export within 30 days of termination. We may also modify or restrict account access if we reasonably believe it is necessary to protect the platform or its users.
13. Intellectual Property
- MOTRaxis, MOTRaxis Workshop, their logos, design, user interface, and source code are the property of Softwairz and are protected by applicable intellectual property laws.
- The Health Score algorithm, scoring methodology, and related calculations are proprietary to Softwairz.
- The Digital Vehicle Passport concept, branding, and implementation are the intellectual property of Softwairz.
- You may not reverse-engineer, decompile, or create derivative works from the app.
- Workshop branding and business information remain the property of the respective workshop.
- Content you submit (reviews, service records, photos) remains yours, but you grant MOTRaxis a worldwide, non-exclusive, royalty-free license to use, display, and distribute such content as part of the Service.
14. Limitation of Liability
- MOTRaxis is provided "as is" without warranties of any kind, express or implied.
- We are not liable for any indirect, incidental, special, or consequential damages arising from the use of the Service.
- We are not responsible for the quality of repair work performed by workshops.
- We do not guarantee the completeness or accuracy of vehicle history records. Service history reflects only data entered into the platform and may not include all maintenance performed on a vehicle.
- The Health Score is an estimate based on available data and should not be treated as a substitute for a professional vehicle inspection.
- We are not liable for data loss caused by device failure, user error, or circumstances beyond our control. We recommend regular use of the backup/export feature.
- Our total liability shall not exceed the amount of platform fees paid by you in the 12 months preceding the claim.

15. Dispute Resolution
- Disputes between workshops and vehicle owners regarding service records may be raised through the platform's dispute mechanism. MOTRaxis will facilitate communication between the parties but is not obligated to adjudicate or resolve such disputes.
- Disputes between you and Softwairz shall first be attempted to be resolved through good-faith negotiation for a period of 30 days.
- If negotiation fails, disputes shall be resolved through binding arbitration administered under the rules of the Pakistan International Arbitration Centre (or equivalent body), and not through court litigation. Each party shall bear its own arbitration costs.
- Class action waiver: you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
16. Modifications to Terms
MOTRaxis may update these Terms from time to time. We will notify registered users of material changes via email or in-app notification at least 14 days before changes take effect. The "Last Updated" date at the top will reflect the most recent revision. Continued use of the Service after changes take effect constitutes acceptance of the modified Terms. If you do not agree with the updated Terms, you may delete your account before the changes take effect.
17. Governing Law
These Terms shall be governed by and construed in accordance with the laws of Pakistan, without regard to conflict of law provisions. Any legal proceedings arising from these Terms shall be subject to the exclusive jurisdiction of the courts in Pakistan, unless resolved through arbitration as described in Section 15.
18. Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy and Disclaimer, constitute the entire agreement between you and Softwairz regarding your use of the Service.
